1. Agreement to Terms

By accessing or using the Branded Boxes website (brandedboxes.eu) and our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. These terms constitute a legally binding agreement between you and Branded Boxes.

2. Our Services

Branded Boxes provides custom packaging design, printing, and manufacturing services to businesses throughout the European Union and internationally. All orders are subject to our production capabilities, material availability, and these terms. We reserve the right to decline any order at our discretion.

3. Quotes and Orders

All quotes provided are estimates and are valid for 30 days unless otherwise specified. Prices are quoted in Euros (EUR) and are exclusive of applicable VAT unless stated otherwise. VAT will be applied in accordance with EU VAT regulations applicable to your location. Final pricing may vary based on artwork requirements, material costs, and order specifications. An order is confirmed only after we receive your approval of the final proof and payment terms have been agreed upon.

4. Artwork and Design

Customers are responsible for providing print-ready artwork that meets our specifications. We offer design services at additional cost. You represent and warrant that you own or have the necessary rights and licences to use all artwork, logos, images, and content submitted for printing. You shall indemnify us against any claims arising from intellectual property infringement in materials you provide.

5. Proofs and Approval

Digital proofs will be provided for your approval before production begins. It is your responsibility to carefully review all proofs for errors including spelling, grammar, colour accuracy, dimensions, and design layout. Once you approve a proof, Branded Boxes shall not be held liable for errors that were present in the approved proof. Colour representation on screen may vary from the final printed product due to differences between digital displays and print processes.

6. Production and Delivery

Standard production time is 2–3 weeks after proof approval. Rush orders may be available at additional cost, subject to availability. Delivery times are estimates and are not guaranteed. We offer free standard delivery throughout the European Union on all orders. Branded Boxes shall not be liable for delays caused by courier services, customs clearance, adverse weather conditions, industrial action, or other circumstances beyond our reasonable control.

7. Payment Terms

Payment terms will be specified in your quote or invoice. For new customers, full or partial payment may be required before production begins. We accept payment by bank transfer (SEPA), credit card, and debit card. Invoices are due within the payment terms specified. Late payments may incur interest in accordance with applicable EU member state legislation on late payment in commercial transactions, implementing EU Directive 2011/7/EU.

8. Minimum Order Quantities

Our standard minimum order quantity (MOQ) is 100 units. Certain products or customisations may have different minimum quantities, which will be specified in your quote. Sample kits are available for most products so you can evaluate quality before committing to a full order.

9. Returns and Refunds

Due to the bespoke nature of our products, all sales are final once production has commenced. If you receive defective products or products that do not match the approved proof, please contact us within 7 days of delivery at support@brandedboxes.eu with photographs of the issue. We will inspect the matter and, at our discretion, reprint the order or provide a refund for defective items. For EU consumers, this does not affect any statutory rights you may have under applicable national consumer protection laws.

10. Consumer Rights (EU)

If you are a consumer located in the European Union, you may have additional rights under applicable EU consumer protection legislation, including the EU Consumer Rights Directive (2011/83/EU). Please note that the right of withdrawal under this Directive does not apply to contracts for the supply of goods made to the consumer's specifications or clearly personalised, which includes all custom packaging orders.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Branded Boxes's total liability shall be limited to the cost of the products ordered. We shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of business, or loss of anticipated savings arising from the use of our products or services. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by applicable law.

12. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Branded Boxes and is protected by EU and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written permission.

13. Force Majeure

Branded Boxes shall not be liable for any failure or delay in performing our obligations where such failure or delay arises from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, industrial action, supply chain disruptions, government actions, or failures of utility services.

14. Dispute Resolution

In the event of a dispute, we encourage you to contact us first at support@brandedboxes.eu so that we may attempt to resolve the matter amicably. EU consumers may also use the European Commission's Online Dispute Resolution platform available at ec.europa.eu/consumers/odr.

15. Governing Law

These Terms of Service are governed by and construed in accordance with applicable EU law and the national laws of the EU member state in which Branded Boxes is established. Any disputes that cannot be resolved amicably shall be subject to the jurisdiction of the competent courts in accordance with applicable EU regulations on jurisdiction.

16. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. For material changes, we will provide reasonable advance notice by email or prominent notice on our website. Your continued use of our website and services following any changes constitutes acceptance of the modified terms.
